But isn’t the Creative Commons CC-BY license necessary to enable data mining of ACS articles?

No, all articles made publicly available through ACS AuthorChoice or ACS AuthorChoice+12 can be text and data mined for non-commercial purposes. In addition, articles made publicly available through our ACS AuthorChoice/ACS AuthorChoice+12 Creative Commons CC-BY option can also be text and data mined for commercial purposes.

Articles not published under an ACS AuthorChoice license can only be text and data-mined through a separate license with ACS. For academic institutions, ACS is exploring several cross-industry initiatives to facilitate data mining of research content for noncommercial purposes.  Organizations seeking to data mine ACS journal articles and related material for commercial purposes, or for commercial redistribution or metadata licensing, should contact ACS directly (Stephen Hansen, Associate Director of North American Sales and Licensing, S_Hansen@acs.org).
